Animaker Inc. is a Delaware Corporation with a mailing address of 3260, Hillview Avenue, Palo Alto, CA-94304, United States of America.
Picmaker is a technology product of Animaker Inc. Any reference to Animaker may include references to all of Animaker’s products, including Picmaker as appropriate and relevant, while including relevant context. The term “Picmaker” refers to the following:
a. Picmaker website accessible through the URL https://www.picmaker.com
b. Any successor URLs, mobile or localized versions and related domains and subdomains.
c. Picmaker’s Do-It-Yourself Visual Content Creation Platform (“Picmaker Services”, “Website”, “Services”, “Picmaker Services”, “Picmaker Website”, “Site”, “Our”, “Us”, “We”).
The terms “Subscriber”, “You”, “Your”, “User” or “Users”, refers to the following: Either individuals or organizations registering their credentials to use Picmaker for any legal purposes.
The terms “Visitor” or “Visitors”, refers to the following: Either individuals or organizations that access Picmaker Services, anonymously without logging in or purchasing a Subscription on Picmaker.
Depending on how you use Picmaker, we collect different types of data:
a. As a Visitor: If you access our website anonymously without logging in or purchasing a Subscription on Picmaker, we will not ask you to provide us with any information.
b. As a Free User: You sign up for a Free Account and become a Free User of Picmaker. We will ask you to provide us with certain Personally Identifiable Information (“PII”). PII is used to create your account. PII enables you to use our website.
c. As a Paid Subscriber: You purchase a Subscription and become a Paid Subscriber. We will require your PII and Payment Data. Your Payment Data will enable us to process your purchase.

a. To Provide Access to Picmaker Features: To provide you access to the features that come with the plan that you had subscribed for.
b. For Enhancing Picmaker Website: We continuously strive to improve the Picmaker website features based on the information and feedback we receive from you.
c. For Communication Purposes: Picmaker shares it’s newsletter and promotional communications through email. These emails contain information and updates pertaining to your Subscription. If a Subscriber no longer wishes to receive Picmaker’s newsletter and promotional communications, they may Opt-Out of receiving them by clicking on the “Unsubscribe" link which appears at the bottom of every email we send. However, it should be noted that Subscribers may be unable to Opt-Out of certain important Picmaker Account related communications.

Yes, Picmaker shares Subscriber Data with certain trusted 3rd party providers who provide a range of services including: Website Performance Improvement Services, Subscriber Support Services, Billing Services, Cloud Hosting Solutions, and Analytics Services. As part of the provision of their services to Picmaker, Picmaker may transfer some of Subscriber’s necessary information to them, for them to perform such services. Picmaker has also entered into contracts with such 3rd party providers in order to ensure that the information that is provided regarding Subscribers is kept confidential and secure. In certain circumstances, we may also disclose your information to other outside parties. This could happen if releasing such information will be appropriate in order to comply with laws and regulations applicable to us. No information will ever be provided to outside parties for marketing, advertising or other such uses without your consent.

Picmaker makes good faith effort to provide its Subscribers with access to their own data for viewing, editing and removal upon request.
Picmaker provides its Subscribers the means to edit their own data if it is inaccurate.
Picmaker will delete such data on request, if it is not otherwise required to be retained by law or for legitimate business purposes.
Picmaker Subscribers may access, correct, update, change or delete their own data at any time.
Picmaker Subscribers may access their own data using features available within Picmaker by signing in to their account and make the desired changes.
Picmaker Subscribers may also access their own data, by emailing Picmaker Support team at email@example.com
Picmaker may decline to process Subscriber data access requests that are unreasonably repetitive or systematic, require disproportionate technical effort. For instance, requests concerning Picmaker Subscriber data residing on backup tapes, jeopardise the privacy of other Subscribers, would be extremely impractical, or for which access is not otherwise required.
In any case where Picmaker provides access and facilitates correction, the service is provided free of charge, except if doing so would require a disproportionate effort.
Please note that if a Picmaker Subscriber deletes their own Subscriber Account or if Picmaker terminates a Subscriber’s access to their Picmaker Account, in accordance with Picmaker Terms of Service Agreement, the Subscriber may no longer have the ability to access or update their data.
Subscriber may trigger an Picmaker Account Deletion request by following either of the following processes: Click on Delete Account button located within their My Account page.
Email Picmaker Support team using the email address: firstname.lastname@example.org using the Subject line “Account Deletion”. Picmaker will respond to all Account Deletion requests within 30 days. Despite deletion request from a Subscriber, Picmaker may retain Subscriber's PII for the following reasons:
a. To comply with a legal obligation.
b. For public health purposes in the public interest.
c. For archiving purposes in the public interest.
d. For scientific research.
e. For historical research.
f. For statistical purposes.
g. For the defense of legal claims.
You have the right to ask us to provide a copy of your data to another entity or a service provider, in the event that you wish to move your account to them. If you wish to have such a copy, please contact us at email@example.com and we shall provide it to you in an electronic and machine readable form so that you may transmit such information to another entity. If it is technically feasible and should you wish, we will transfer such information directly to such another entity at your request. Please be advised we will not be able to provide you with such a copy or transfer such information to such an entity if it would adversely affect the rights and freedoms of other Subscribers.
Picmaker may share Subscriber Data with a 3rd party, after obtaining prior consent from respective Subscriber(s).
Picmaker does not sell, trade, share or transfer Subscriber Data to 3rd parties except in the following limited circumstances:
Picmaker may share Subscriber Data with its subsidiaries and affiliates and 3rd party service providers.
Picmaker may share Subscriber Data for marketing or advertising of Picmaker Services.
Picmaker may share Subscriber Data with its service providers for direct emailing of its newsletters or notifications of Picmaker.
Picmaker may share Subscriber Data with its partners who offer Picmaker to Subscribers jointly with Picmaker.
Picmaker may share Subscriber Data to process payments.
Picmaker may share and/or transfer Subscriber Data, if Picmaker becomes involved in a merger, acquisition, bankruptcy, or any form of sale of some or all of its assets.
Picmaker may share Subscriber Data with service providers and government entities to detect, prevent, or otherwise address fraud or security or technical issues.
Picmaker may share Subscriber Data when it has a good faith belief that access, use, preservation or disclosure of such Subscriber Data is reasonably necessary to accomplish the following:
a. Satisfy any applicable law, regulation, legal process or enforceable governmental request;
b. Enforce Picmaker Terms of Service Agreement, including investigation of potential violations thereof;
c. Protect against imminent harm to Picmaker rights, property or safety, or that of Subscribers or the public as required or permitted by law;
Picmaker may share aggregated or anonymized Subscriber Data with 3rd parties for other purposes.
Anonymized Subscriber Data does not identify Subscribers individually, but may include usage, viewing and technical data such as the types of services, Picmaker Subscribers generally use, the configuration of their computers, and performance metrics related to the use of Picmaker which Picmaker has collected.
The security of Subscriber Data is important to Picmaker.
Picmaker has in place, physical, electronic, and procedural safeguards designed to protect Subscriber Data.
Sensitive Subscriber Data like passwords and CVV numbers are encrypted in transit using industry-standard Transport Layer Security (TLS) encryption technology.
All sensitive information, including credit card details, is transmitted via Secure Socket Layer (SSL) technology, and then encrypted into our payment gateway providers database, which is only accessible to those authorized with special access to each system.
No method of transmission over the Internet, method of electronic storage or other security methods are one hundred percent secure. Therefore, while Picmaker strives to protect Subscriber Data, Picmaker cannot guarantee its absolute security.
Picmaker shares limited access to Subscriber Data with its employees, in order to provide relevant Picmaker to Subscribers. However, such privileged access comes with strict controls and logs monitoring the employee’s use.
Picmaker may retain Subscriber Data:
a. As necessary to support Picmaker.
b. To comply with Picmaker’s own legal obligations.
c. To resolve disputes.
d. Any content posted by Subscribers, may remain on Picmaker, even after the Subscriber ceases using Picmaker or even after Picmaker terminates their access to Picmaker’s Services.
Picmaker is not for use by Subscribers under the age of 13.
Picmaker will not and does not ask for, or knowingly collect any Data from Subscribers under the age of 13.
Visitors to our website under the age of 13 or younger, will not be required to disclose their personal data.
Student Subscribers under the age of 13 accessing Picmaker and/or any other subdomain, under the direction of a school project, will have to provide the contact details of their teacher, rather than their own personal data.
If you are under the age of 13, you should not attempt to send or send any Data, including, but not limited to, about yourself to Animker, including your name, address, telephone number, or email address.
If you are a parent or legal guardian or teacher of a Subscriber under the age of 13 and believe that Picmaker might have any Data from or about a Subscriber under the age of 13, please email us at firstname.lastname@example.org
In the event that we become aware by confirmation, that we have collected any Data from any Subscriber under the age of 13, we will delete that Data promptly and inform you of the details.
If and when the changes are made, the “Last Edited” date on this page will reflect the same.
If and when the changes are made, Subscribers will be notified, on this page, by email or through notice on other relevant web pages within Picmaker.
